MERITA LAURÉL SHOP


1. GENERAL


1.1 The domain meritalaurel.com is a website operated by Merita Laurél by Gregor Art + Music, (hereinafter referred to as "Merita Laurél Shop", "us" or "we"), located at Bogenstraße 51, 20253 Hamburg, Germany.


1.2 These Terms and Conditions apply when you as a Customer (hereinafter referred to as the “Customer” or "you") place an order via www.meritalaurel.com and related pages, (the “Website”). With these agreement you also confirm that you have read and approved our Privacy policy.


1.3 In order to make purchases on our web site, the Customer must, according to German law, be at least 18 years old.


1.4 Merita Laurél Shop reserves the right for any image and writing errors on the page, such as errors in description, technical specification, prices and price adjustments. In case of incorrect price for an item ordered, Merita Laurél Shop will inform the Customer of this and await the Customer's approval of the corrected price before proceeding with the order.


1.5 The Website and all its content is owned by Merita Laurél by Gregor Art + Music or its licensors. This means that everything on the website may not be copied or used without the prior written consent of Merita Laurél by Gregor Art + Music.


1.6 All products offered by Merita Laurél Shop are protected by copyright. Each product is licensed to a single user for personal use only. Customers are not permitted to copy, distribute, share or transfer the product they have purchased for sale to any third party or person. In some cases, Merita Laurél Shop may encrypt its digital products to provide additional security.



2. ORDERS


2.1 When the Customer has placed an order on the Website, a purchase agreement has been entered into between the Customer and Merita Laurél Shop. Merita Laurél Shop recommend the Customer to save the order confirmation for any future contacts with our customer service. The order confirmation is also the receipt that the purchase has been completed.


2.2 The Customer is responsible for ensuring that the information provided, such as email, name and address is correct and up to date.



3. PRICES AND PAYMENT


3.1 The prices on our Website apply to orders placed on the Website. All prices are shown including VAT (for delivery within the EU). VAT is not included in countries outside the EU.

Merita Laurél Shop offers free shipping worldwide.


3.2 The Customer is responsible for any customs duties being paid to the customs or equivalent authority in the country to which the product / products are finally delivered.


3.3 The Customer can see prices, and choose to pay in the following currencies:

3.4 All transactions to purchase our products are processed through the online payment gateway PayPal™. These allow customers to use common types of credit and debit cards in different countries. Card information is not stored with us and all card information is processed via SSL encryption. Please read the terms and conditions for the payment gateway selected for the transaction as they are responsible for the transactions carried out.



4. DELIVERY OF DIGITAL PRODUCTS


4.1 All digital streaming media (video bundles) purchased at Merita Laurél Shop are accessible immediately after purchase. The Customer is directed to our website immediately after checking out with PayPal™ and receives a personal password to stream the purchased video bundle. The Customer needs Internet access on any common streaming device such as smartphone, tablet, computer, notebook or Smart TV. Streaming media is available online and can be viewed by the Customer as often as you like for 90 days from the date of purchase.


4.2 For all other digital products purchased at Merita Laurél Shop, such as e-books, audio books or digital music, the Customer receives an individual password immediately after purchase in order to access the protected download page. Here, you can immediately download the purchased product on your device, such as smartphone, tablet, computer or notebook. The personal password for the download page is valid for 48 hours from the date of purchase to download the purchased files.


4.3 If you may not be redirected to the download/streaming area on our website after purchasing a digital product or you do not receive an e-mail from PayPal™ with your order confirmation after placing the order, please contact our custumer support via email to support@meritalaurel.com with your transaction details. We will get back to you as soon as possible, usually within two business day.



5. SHIPPING AND DELIVERY OF PHYSICAL PRODUCTS


5.1 The Customer's order of physical products, such as photo prints, usually leaves Merita Laurél Shop’s warehouse within six (6) to eight (8) working days, unless otherwise agreed or stated in the order confirmation or in the product page, and will be delivered to the customer by registered mail. The time period for the shipping company to send the package to the customer may vary depending on which country the package should be sent to. Merita Laurél Shop reserves the right to possibly adjust the delivery time. Information on this should be sent to the customer for approval.


5.2 Delivery will be made no later than 30 working days after Merita Laurél Shop has confirmed the order in writing through the order confirmation.


5.3 If the order is delayed more than 30 days, the Customer has the right to cancel their order.


5.4 Some of our packages can be delivered directly to the Customer's mailbox, but sometimes, depending on the shipping company’s handling in the country of delivery the Customer receives a notification via email or ordinary mail to pick up the package from a specific delivery point or post office and within the time specified in the notification.


5.5 If the package is not retrieved, Merita Laurél Shop has the right to charge the Customer a fee for freight and administrative costs.

5.6 The tracking number for each package will be sent to the Customer via email when the packages leaves Merita Laurél Shop’s warehouse.


5.7 Merita Laurél Shop is responsible for any damage that may occur during the shipment to the Customer. If, upon receipt, the Customer discovers that the shipment is damaged in transport, either on the product or on the packaging, we ask the Customer to notify the shipping company.

After that, the Customer must report the damage to our customer service, by sending an email to support@meritalaurel.com, with attached pictures, so that Merita Laurél Shop can help the Customer with the complaint, in the best way possible. This also applies to any hidden damage. Visible damage should preferably be reported to us on the same day as delivery. Hidden damage should preferably be reported to us within five (5) working days of receipt. It is therefore important that the Customer unpack and inspect the products thoroughly as soon as possible after delivery.



6. RETURNS, WITHDRAWAL & EXCHANGE OF PHYSICAL PRODUCTS


6.1 When purchasing physical products such as Fine Art Photo Prints or printed books on the Website, the Customer has a 14-day withdrawal period. This means that the Customer has the right to cancel the purchase by notifying Merita Laurél Shop accordingly within 14 days from when the Customer or their representative received the product ordered (withdrawal period). 


6.2 If the Customer uses their right of withdrawal, the Customer is responsible for the condition of the product after the Customer has received the product and during the return shipping. The product shall be returned within 14 days from the date when Merita Laurél Shop was notified of the withdrawal. The product shall be sent in its original condition, well packaged, preferably in the original package. If the product’s condition is altered in any way, additional costs may apply to the Customer. The Customer shall register their return via email to support@meritalaurel.com. The Customer shall provide their name, address and other relevant information, e.g. order reference, invoice number and the name of the product in the message. After registration the Customer will receive an email containing instructions and address details for sending back the package. Customer should not attempt to make a return before contacting Merita Laurél Shop.


6.3 The Customer is responsible for the transport risk and shipping cost for the return. Please note that the return must be sent as a traceable shipment. Merita Laurél Shop suggests the Customer to save the tracking number and proof of postage until Merita Laurél Shop has received the return. 


6.4 As soon as the return reaches Merita Laurél Shop’s warehouse, and has been processed, Merita Laurél Shop will make a refund to the customer. All refunds will be made via PayPal. 


6.5 If the Customer wants to do an exchange of the product(s), it is processed as a return, i.e, the customer sends the product(s) back to Merita Laurél Shop, as set forth in 6.1 to 6.4. The Customer can then make a new order.


6.6 Merita Laurél Shop can not offer the right of return or exchange of custom/special made orders.



7. RETURNS, WITHDRAWAL & EXCHANGE OF DIGITAL PRODUCTS


7.1 All purchased digital items from Merita Laurél Shop are non-refundable. 


7.2 All digital products offered for sale at Merita Laurél Shop are considered "used" after given access to the the download area, after downloading or opening. Unfortunately, this means that we have a strict no-refund policy for dissatisfaction with the product and do not accept returns, withdrawals, exchange, credits or refunds.

This applies equally to all analogue products of the Merita Laurél Shop, such as personalized photo prints, cards, CD’s, physical books or other analogue media formats, that are individual copies personalized for the respective customer.



8. ADDITIONAL INFORMATION


Merita Laurél Shop reserves the right to refuse a customer's order without giving reasons. In this case, Merita Laurél Shop will refund the rejected customer the price paid for the purchased products within 2 business days via PayPal™ transaction.



9. FORCE MAJEURE


Merita Laurél Shop shall be exempt from damages and other measures if the performance of the agreement is prevented or delayed by any circumstance beyond our control, e.g. extreme weather, new / amended legislation, absent permits, war, fire, flood, labor market disturbances, technical problems, sabotage, unfavorable transport, terrorist attacks, changed governmental orders as well delays in the service by sub-suppliers due to circumstances set forth above. Merita Laurél Shop shall inform the Customer accordingly if any such circumstances should arise, and if the situation has lasted more than six weeks, both the Customer and Merita Laurél Shop have the rights to cancel the purchase with immediate effect.



10. CHANGES TO THE TERMS AND CONDITIONS


Merita Laurél Shop may make changes to the Terms of Conditions from time to time. When these changes are made, Merita Laurél Shop will make a new copy of the Terms and Conditions available on its website.

Your continued use of our website after any changes to the Terms and Conditions means you accept the changes.



11. GOVERNING LAW


These General Terms and Conditions and any separate agreements in which we offer services to you shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.
